Empowering Your Representatives: A Guide to Powers of Attorney

A Power of Attorney (POA) is a legal document that authorizes an individual — called an agent or attorney-in-fact — to act on behalf of the principal in various matters. Whether managing finances, making medical decisions, or handling specific transactions, a properly notarized POA is essential.

Types of Powers of Attorney
#

Financial Power of Attorney Handles banking transactions, investments, real estate, and property sales on behalf of the principal.

Medical Power of Attorney Empowers an agent to make healthcare decisions, including treatment options, when the principal is unable to do so.

General Power of Attorney Provides broad authority across financial, legal, and personal matters. Typically becomes void if the principal becomes incapacitated.

Durable Power of Attorney Remains in effect even if the principal becomes incapacitated — often the preferred choice for long-term planning.

Limited Power of Attorney Restricts the agent’s authority to specific tasks or decisions, such as a single real estate closing.

Creating a Power of Attorney

The process typically involves:

  1. Selecting a trusted and capable agent
  2. Clearly defining the scope of granted powers
  3. Completing a state-compliant POA form (Virginia-specific requirements apply)
  4. Having the document notarized by a licensed notary public

Notarization Requirements in Virginia
#

Virginia requires notarization for most powers of attorney to be legally effective. Our notaries will:

  • Verify the principal’s identity using valid government-issued photo ID
  • Confirm the principal understands the document and is signing voluntarily
  • Witness the signature and complete proper notarization with seal and commission information

What to Bring
#

  • Valid government-issued photo identification
  • Your completed, unsigned POA form (do not sign until in front of the notary)
  • Any required witnesses (some POA types require witnesses in addition to notarization)
